TERMS OF SALE

These terms govern pre-orders placed at hardgap.com with Kuykendall Industries LLC ("we", "us"). By placing a pre-order you agree to them.

1. What you are buying

A pre-order is a reservation of a unit from a future production run of the HardGap Sovereign Identity Card. The device is not manufactured at the time you pay. You are funding a production run and holding a place in it.

Specifications published on this site describe the device as designed. Components may change where a part becomes unavailable or where testing shows a better option; we will not reduce the security properties described on this site without telling every deposit holder first and offering a refund.

2. Editions and pricing

All prices are in US dollars. The deposit is applied in full against the total price; it is not a fee. Taxes, duties, and shipping are calculated separately at the time the balance is charged. Sales tax, VAT, and import duties are calculated against your shipping destination at the time the balance is charged, and are shown to you before you pay it.

3. Payment

Payments are processed by Stripe. We do not receive or store your card details. Placing a pre-order authorises the deposit only. The balance is never charged automatically — we email you when it is due and you pay it deliberately.

4. Founders Edition numbering

Founders numbers 1 through 100 are assigned first-come, first-served at the moment payment clears, by an atomic database operation. Two orders cannot receive the same number. If the last number is claimed while your payment is being confirmed, your deposit is refunded automatically and in full.

A Founders number is tied to the order, not to you personally, and is not transferable between accounts.

5. Engraving

Founders cards carry custom engraving in place of the HARDGAP mark. Permitted characters are uppercase A–Z, digits 0–9, hyphens, periods, and spaces, to a maximum of 18 characters. This is a physical constraint of CNC engraving on Grade 5 Titanium at credit-card scale, not a stylistic choice.

You are responsible for the text you submit. We may refuse to engrave text that is unlawful, that infringes a trademark, or that we reasonably consider abusive; if we refuse, we will contact you for alternative text or refund you in full.

Engraving is permanent and cannot be corrected after cutting. You may change your text at any time before your unit enters manufacturing.

6. Delivery

We do not publish a ship date. Manufacturing begins when the production run is funded; shipping follows manufacturing and testing. Progress is published on the Journey page and emailed to deposit holders at each stage.

Any timeframe we give is an estimate, not a contractual commitment, and estimates change. If delay is unacceptable to you, the refund policy applies.

Risk of loss passes on delivery to the address you provide. Keeping that address current is your responsibility.

7. Export control

Cryptographic hardware is subject to export control in some jurisdictions. You may not export or re-export the device in violation of applicable law. If we cannot lawfully ship to your destination, we will tell you before charging the balance and refund your deposit in full.

8. Refunds

Refunds are governed by the refund and cancellation policy, which forms part of these terms. In summary: fully refundable until manufacturing begins on your unit; non-refundable after, with written notice before that point.

9. Your account

You are responsible for keeping your account credentials secure and for activity under your account. Tell us promptly if you believe it has been compromised. You may delete your account at any time from account settings; deleting it does not cancel a pre-order or trigger a refund, and you should request a refund first if that is what you want.

10. The device is not a custodian

The HardGap card generates and holds private keys that only you control. We cannot recover your keys, your recovery seed, or any assets secured by them. There is no backdoor, no key escrow, and no recovery service. If you lose your recovery seed and your card, the assets are unrecoverable by anyone, including us. This is the product working as designed.

You are solely responsible for recording and protecting your recovery seed.

11. Warranty

Twelve months from delivery against manufacturing defects and faults in workmanship. If the card fails in normal use within that period we repair or replace it at our option, and we pay shipping both ways.

It does not cover physical damage, immersion beyond the IP68 rating, a card that has been opened or disassembled, or loss of assets for any reason.

Except as expressly stated, the device is provided without warranties of any kind to the fullest extent permitted by law. Nothing here limits a statutory guarantee your jurisdiction does not permit us to exclude.

12. Limitation of liability

To the fullest extent permitted by law, our total liability arising out of these terms or your use of the device is limited to the amount you paid us. We are not liable for loss of digital assets, loss of a recovery seed, loss of profits, or indirect or consequential loss.

Nothing in this section limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

13. Governing law

These terms are governed by the laws of the State of Idaho, United States, without regard to conflict-of-laws principles. The courts of Ada County, Idaho have exclusive jurisdiction, except where your local consumer-protection law gives you the right to bring proceedings where you live.

14. Changes to these terms

We may revise these terms. Changes do not apply retroactively to a pre-order already placed. Material changes are emailed to deposit holders before taking effect.
